US USPTO Trademark Office Fees Rise

The new fee standards of the United States Patent and Trademark Office (USPTO) have been implemented since January 2, 2021. USPTO stated that the overall strategy of the Final Rules is to strike a balance between a reasonable and affordable fee table and sufficient multi-year income to recover the total cost of maintaining USPTO trademark related business and achieving USPTO trademark related strategic goals.
Initial application fee for electronic applications
Option 1: TEAS standard application Option 2: TEAS non-standard application
$250 per category of goods/services $350 per category of goods/services
The cost of obtaining a trademark depends on the chosen application basis and the initial application form used. Each of these application options has specific requirements that affect the amount of fees. There are certain factors in calculating the application fee for the initial application:
Number of trademarks: Only one trademark can be submitted per application. If you have multiple trademarks, you need to apply separately, and each trademark has its own application fee
Number of categories: You must pay for each category of goods and/or services in the application. For example, if the application is for a trademark that is used for two different categories of goods, such as computer software in category 9 and T-shirts in category 25, the application fee for both categories needs to be paid in order to be approved.
Additional fees that may arise from intentional use of the application
Request an extension of time to display the use of the trademark (if not part of the initial application): $125 per category;
Display usage (if not part of the initial application): $100 per category.
After trademark registration
1. Submit the use statement after 5 years (§ 8 statement): 225 dollars per category (if submitted before the grace period);
2. Submit the use statement (Article 8 statement) and uncontested statement (Article 15 statement) after 5 years: 425 dollars per category (if submitted before the grace period);
3. Submit use declaration and renewal application every 10 years (combining § 8 declaration and § 9 renewal): $525 per category (if submitted before the grace period).
4. Submit an undisputed statement (§ 15 statement): $200 per shift.
Note: If submitted within the grace period, additional fees will be required.
